Bill 148: Fair Workplaces Better Jobs Act, 2017

The Ontario government has passed the Bill 148 on November 22, 2017.  The Bill amends the Employment Standards Act, 2000 (ESA) and the Labour Relations Act with a target effective date of January 1, 2018.  The Bill stills needs to receive Royal Assent.

To help employers navigate the Bill 148 changes in the ESA, the following table highlights the key changes that employers need to of:

OTHER:

  • An additional 175 ESA Officers will be hired to audit that these changes are implemented by Ontario employers.  In 2018, the audit blitz is expected to affect one in ten (1:10) organizations.
  • Maximum fines have increased from $250, $500, and $1,000 to $350, $750, and $1,500 depending on the infraction. 
  • Under the new legislation the government will publish the names of the employers who are fined.
